The Central Board of Direct Taxes (CBDT) has issued an important advisory to bring uniformity in determining the inter-se seniority of Inspectors promoted from the Ministerial and Stenographer Cadres. The clarification explains how Recruitment Rules and DoPT guidelines should be applied while preparing seniority lists, and is expected to resolve long-standing disputes in several Income Tax Regions. Here’s everything you need to know.
The clarification has been issued vide F.No. HRD/CMD-IIa/OMs/22/02/26-27/2974 dated 20 August 2026, along with a detailed advisory for all Principal Chief Commissioners of Income Tax (Pr. CCsIT) and Cadre Controlling Authorities.
This advisory seeks to ensure uniform implementation of Recruitment Rules and DoPT instructions across all Income Tax Regions and to avoid inconsistencies in fixation of seniority.
Why Was This Clarification Issued?
The issue arose after references received from the Principal Chief Commissioner of Income Tax, Delhi concerning disputes over the fixation of inter-se seniority of Inspectors promoted under the Recruitment Rules for Inspector, 1969/1986.
Certain officials had challenged the seniority list on the ground that greater weight had been given to the Year of Passing (YOP) of the Departmental Examination, allegedly resulting in some seniors in the feeder cadre being placed below their juniors.
The Directorate of HRD examined the matter in light of:
- Earlier HRD clarifications
- Relevant DoPT Office Memoranda
- The Recruitment Rules
- The judgment of the Hon’ble Supreme Court
- Existing promotion procedures followed by the Department.
Background of the Advisory
The advisory notes that:
- The Recruitment Rules of 1969 (as amended in 1986) governed promotions to the post of Inspector for many years.
- The Department had already issued clarifications in 2023 and 2025 on the same subject.
- Since different regions were following different practices, a comprehensive advisory became necessary to maintain uniformity.
Existing Promotion Mechanism
Under the old Recruitment Rules, promotions were made from two feeder channels:
- Ministerial Cadre
- Stenographer Cadre
The prescribed quota was:
- 3:1 ratio between Ministerial and Stenographer Cadres
- Within each cadre, selection was made in the ratio of:
- Seniority
- Year of Passing of Departmental Examination (1:1)
Separate select lists were prepared for each category before a consolidated promotion panel was drawn.
Most Important Clarification
The advisory makes one principle absolutely clear:
The Year of Passing the Departmental Examination is relevant only for selection by the DPC and not for determining inter-se seniority after promotion.
Once officers are selected by the Departmental Promotion Committee (DPC):
- Seniority must be determined according to the applicable Recruitment Rules.
- Officials from different feeder cadres are to be arranged in the prescribed quota.
- The relative seniority maintained in their respective feeder grades must be preserved.
In other words, passing the examination earlier does not automatically make an officer senior after promotion.
Role of DoPT Instructions
The CBDT advisory refers to the following DoPT Office Memoranda (OMs) and FAQs on seniority. I searched for the relevant official references and related compilations. Where the original OM is difficult to access individually, the official DoPT compilation contains the complete text.
| Office Memorandum / FAQ | Subject |
| MHA OM No. 9/11/55-RPS dated 22.12.1959 | General Principles for Determining Seniority |
| DoPT OM No. 20019/2/83-Estt.(D) dated 10.09.1985 | Seniority where promotions are made through DPC |
| DoPT OM No. 20011/1/88-Estt.(D) dated 12.12.1988 | Modification of seniority principles |
| DoPT OM No. 20011/1/2008-Estt.(D) dated 11.11.2010 (FAQs on Seniority) | Frequently Asked Questions on Seniority |
| Consolidated DoPT OM dated 16.09.2022 | Master instructions on determination of seniority |
According to these instructions:
- Officers promoted from more than one feeder grade are first arranged according to their seniority in their respective feeder cadres.
- After assessment by the DPC, their names are inter-polated in the ratio prescribed under the Recruitment Rules.
- Seniority after promotion should mirror the relative seniority in the feeder grade rather than the order in which the departmental examination was passed.
Preparation of Promotion Panel
The advisory distinguishes between two separate stages:
Stage I – Selection List
Eligible officers are identified from both feeder cadres based on:
- Seniority
- Year of Passing of Departmental Examination
This stage is only meant for selecting officers for promotion.
Stage II – Consolidated Promotion Panel
After selection:
- The lists from both cadres are merged.
- Inter-se seniority is fixed strictly in accordance with:
- Recruitment Rules
- Applicable DoPT Instructions
The advisory specifically states that these two stages should not be treated as one continuous exercise.
Supreme Court Judgment Relied Upon
The advisory also refers to the judgment of the Hon’ble Supreme Court in K.C. Sharma & Others, wherein the Court upheld the validity of the promotion mechanism prescribed under the Recruitment Rules.
The judgment recognized that:
- Separate feeder channels could legitimately exist.
- The prescribed quota system was valid.
- Merit through departmental examination could be considered during selection.
- However, inter-se seniority after promotion had to be fixed according to the Recruitment Rules and applicable DoPT instructions.
What Cadre Controlling Authorities Should Verify
While examining cases relating to seniority, authorities have been advised to verify:
- Whether the prescribed 3:1 quota between Ministerial and Stenographer Cadres has been followed.
- Whether selection within each cadre was made in the prescribed 1:1 ratio.
- Whether eligible officers were selected by the same DPC.
- Whether feeder grade seniority has been maintained.
- Whether the consolidated promotion panel was prepared correctly.
- Whether the final seniority list is supported by the DPC records.
Objective of the Advisory
The Directorate has clarified that the purpose of issuing this advisory is to:
- Ensure uniform implementation across all Income Tax Regions.
- Maintain consistency in fixation of inter-se seniority.
- Avoid conflicting interpretations of Recruitment Rules.
- Reduce avoidable litigation.
- Ensure that promotion records are prepared in accordance with DoPT instructions.
Key Takeaways

- ✅ Relative feeder cadre seniority should ordinarily be preserved after promotion.
- ✅ Consolidated promotion panels must be prepared strictly according to the prescribed quota.
